DHSS Lawsuit Settlement Information
ASHNHA has reached a settlement agreement with the State of Alaska on our lawsuit regarding use of the emergency regulatory process to enact provider rate cuts. As part of the agreement, all Medicaid providers may be eligible for a one time financial settlement representing the difference between current reimbursement for Medicaid services, and the amount you would have been paid had the emergency regulations not gone into effect for the first quarter of state FY20. Depending on provider type, you could be eligible for a payment representing the 5% rate cut and a 1% inflationary adjustment on your Medicaid claims for July 1, 2019 – Sept. 30, 2019. For mental health clinician services, eligible dates for a claim are between July 1, 2019 and October 30, 2019.
To be eligible for this settlement, you must submit the form by Nov. 1, 2019 at 12 noon. ASHNHA members will submit the form to ASHNHA to email [email protected]. All other Medicaid providers will submit the form to [email protected].
The form must be completed for each Medicaid provider number that billed. Refer to Exhibit B in the settlement document which lists all eligible and non-eligible providers.
