DHSS Lawsuit Settlement
ASHNHA reached a settlement agreement with the State of Alaska on a lawsuit regarding use of the emergency regulatory process to enact provider rate cuts. As part of the agreement, all Medicaid providers may be eligible for a one time financial settlement representing the difference between current reimbursement for Medicaid services, and the amount you would have been paid had the emergency regulations not gone into effect for the first quarter of state FY20. Depending on provider type, you could be eligible for a payment representing the 5% rate cut and a 1% inflationary adjustment on your Medicaid claims for July 1, 2019 – Sept. 30, 2019. For mental health clinician services, eligible dates for a claim are between July 1, 2019 and October 30, 2019.
The deadline to submit information for the settlement was Nov. 1, 2019. All settlement payments will be made by April 1, 2020.
